Passage of HB 154 Allows Search Warrants for Blood Draws

House Bill 154 permits the issuance of search warrants for blood draws when offenders refuse to take a breath, blood or urine test offered by a law enforcement officer after being charged with KRS 189A.010.

 On April 5, 2022, House Bill 154 went into effect as emergency legislation.  This law now allows search warrants to be issued when a subject charged with a violation of KRS. 189A.010 refuses to take a blood, breath or urine test when requested to do so by a law enforcement officer.  Under previous law, search warrants could only be issued when a fatality or physical injury occurred in connection with an impaired driving case.
